Terms of Service

1. Acceptance of Terms

By accessing and using the WheelUp platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. WheelUp reserves the right to modify these terms at any time, with changes effective upon posting.

2. Eligibility

You must be at least 21 years old and hold a valid driving license issued in India (or an International Driving Permit for foreign nationals) to rent a vehicle through WheelUp. By creating an account, you confirm that all information provided is accurate and complete.

3. Account Registration

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify WheelUp immediately of any unauthorized use of your account. WheelUp is not liable for any loss arising from unauthorized use of your account.

4. Booking & Payment

All bookings are subject to availability and host confirmation. Payments are processed securely through our payment gateway. Prices displayed include applicable taxes unless stated otherwise. A security deposit may be required at the time of pickup and will be refunded upon satisfactory return of the vehicle.

5. Cancellation & Refunds

Free cancellation is available up to 24 hours before the scheduled pickup. Cancellations made within 24 hours may incur a cancellation fee as specified in the booking. Refunds are processed within 5-7 business days to the original payment method.

6. Vehicle Usage

Rented vehicles must be used in accordance with traffic laws. The vehicle must not be used for commercial purposes, racing, off-roading (unless specified), or driven under the influence of alcohol or drugs. Sub-letting the vehicle is strictly prohibited.

7. Insurance & Liability

All vehicles on WheelUp come with basic insurance coverage. The renter is liable for any damage exceeding the insurance coverage, negligent damage, or damage caused by violation of these terms. Additional insurance options may be available at the time of booking.

8. Host Responsibilities

Hosts must ensure their vehicles are in safe, roadworthy condition and accurately represented on the platform. Hosts must maintain valid insurance, registration, and all required permits for their vehicles.

9. Dispute Resolution

Any disputes arising from the use of the Service shall be resolved through arbitration in Mumbai, Maharashtra, in accordance with Indian Arbitration and Conciliation Act, 1996. The language of arbitration shall be English.

10. Limitation of Liability

WheelUp acts as a marketplace connecting hosts and renters. We are not responsible for the condition of vehicles, host/renter behavior, or any incidents during the rental period, except as required by law. Our total liability shall not exceed the amount paid for the specific booking in question.

11. Privacy

Your use of the Service is also governed by our Privacy Policy. By using WheelUp, you consent to the collection and use of your data as described therein.
